Terms of Use

These terms govern use of the website and online services provided by More Than Conquerors Inc., known as MTC Surf ("MTC," "we," or "us"). They cover accounts, registrations, volunteer applications, online communications, donations, and purchases made directly through MTC.

Where an online action asks you to accept these terms, read them before accepting. If you do not agree, do not complete that action. Our Privacy Policy explains our information practices. Payment cancellations and refund requests are addressed in the Payment and Refund Policy.

1. Who may use the services

Provide accurate information and use the services only for lawful MTC-related purposes. Teenage volunteers aged 13–17 may have their own accounts. If you are under 18, involve a parent or legal guardian and comply with the age and permission requirements for the particular activity. Do not create an account or submit information directly if you are under 13. Participant registrations, payments, and agreements that require adult consent must be completed by an adult with the necessary authority.

If you act for a participant, guest, organization, or another person, you must have authority to provide their information and make the relevant request. Caregiver status or possession of someone's email address alone does not establish authority to sign on their behalf. Adults participating in a program retain their own consent rights unless a representative has lawful authority to act for them.

2. Accounts and access

Keep login credentials, verification codes, private ticket links, and recovery links secure. Do not share an account or use another person's account. Tell us promptly if you suspect unauthorized access.

Account access depends on your current role and the activity concerned. Having an account does not guarantee a registration, volunteer approval, event assignment, administrative access, or a ticket. MTC may restrict or suspend access when reasonably necessary for safety, security, misuse, inaccurate information, or applicable program rules. Access changes do not eliminate payment or other rights that cannot lawfully be waived.

3. Program registration and participation

Follow the eligibility, capacity, preparation, and event instructions shown for the activity. A submitted request or waitlist entry is not a confirmed place. Rely on the confirmation and status MTC provides, and contact us if those appear inconsistent.

Tell MTC promptly if a participant cannot attend or if information relevant to safe participation changes. Use the available cancellation controls or contact the event team. Event plans may change because of weather, ocean conditions, safety, staffing, venue availability, or other circumstances. Follow instructions from the event lead and safety team.

These website terms do not replace the separate participant liability waiver, assumption-of-risk agreement, guardian authorizations, or event instructions. Any waiver or release must be reviewed and accepted through its designated process by someone with proper authority. Optional participant photo/video permission remains a separate choice.

Website information and chat are not emergency services or individualized medical advice. For an emergency, contact emergency services rather than relying on website messages.

4. Volunteering

Volunteer applications, preparation acknowledgments, and Live Scan reports are subject to MTC review. Reporting that you attended Live Scan or received a confirmation does not itself establish approval or an event assignment. Follow the current training and clearance instructions and provide accurate status information.

General volunteer approval and approval or assignment for a particular event are separate. Apply for the event or role you want and wait for MTC's confirmation. Access to the Volunteer Hub does not guarantee availability, a specific role, or permission to attend an event as staff. MTC may change assignments for safety, suitability, capacity, or operational reasons.

Volunteering is not an offer of paid employment. These terms do not create a new volunteer waiver or replace any separately applicable volunteer policies.

5. Donations, tickets, tables, and sponsorships

Review the amount, currency, quantity, event, and included benefits before paying. Purchases are subject to availability and successful payment. A pending payment or checkout session is not a confirmed order. If a payment error or fulfillment problem occurs, contact us rather than repeatedly submitting payment.

A ticket or table provides only the admissions and benefits described for that purchase. A sponsor package provides the benefits specified for that tier or in a separate written agreement. A package's fundraising purpose does not mean its entire price is a charitable contribution. Providing guest names does not create admissions beyond the purchased allocation.

MTC uses Stripe for online payment processing. You must be authorized to use the payment method. Applicable taxes and the final total will be disclosed before payment; mandatory charges must be included in advertised prices where required by law. Any optional additional contribution must be a separate, voluntary choice.

Tickets, tables, and sponsorships are non-refundable. If MTC Surf cancels the event, we will issue a full refund. This applies to Rise With the Tide event purchases. Refunds are not available for buyer cancellations, inability to attend, late arrival, or no-shows. Completed voluntary donations are non-refundable and are separate from event purchases. These rules do not limit rights required by applicable law or payment rules. Read the full Payment and Refund Policy before paying.

A later policy change does not remove a refund right or other promise made for an earlier purchase. A separate signed sponsorship agreement controls its specific subject matter if it conflicts with these general terms, subject to applicable law.

6. Monthly donations

If you select a monthly donation, you authorize the amount and recurring frequency disclosed during signup until you cancel future charges. A one-time donation does not authorize recurring charges.

Visit Monthly donation help for the currently available cancellation method, or email elle@mtcsurf.org from the address associated with your gift. Where a secure self-service portal is available, you may use it. Otherwise, contact MTC for cancellation and request confirmation of the effective date and any payment already being processed. Account closure, newsletter unsubscribe, and deletion of a message do not cancel a recurring donation.

Cancellation stops future charges once effective; it does not ordinarily refund completed gifts. MTC must honor applicable rights concerning revoked payment authorization, billing errors, and unauthorized charges. An internal processing delay does not waive those rights.

7. Tax information

More Than Conquerors Inc. is listed by the IRS as eligible to receive tax-deductible charitable contributions, EIN 85-3549068. Whether a particular payment is deductible, and in what amount, depends on applicable tax rules and your circumstances.

Tickets, meals, merchandise, admission, advertising, or other benefits may reduce or eliminate a charitable deduction. A payment-processor receipt alone is not a determination of your deductible amount. Where required, MTC will provide a separate acknowledgment or benefit-value disclosure. Do not treat a payment as fully deductible solely because MTC is a nonprofit or because an internal record calls it a donation. Consult your tax adviser about your circumstances.

8. Communications and acceptable conduct

Use messages and event conversations respectfully and only for appropriate MTC purposes. Do not harass, threaten, impersonate, solicit unlawfully, share private participant information without authority, send unwanted promotions, upload malicious material, or interfere with the services. Do not attempt to access records, administrative functions, or accounts you are not authorized to use.

Only submit material you have the right to provide. For material you submit, you give MTC permission to store, display to the intended recipients, and otherwise use it as needed to provide the requested service. This permission does not grant an unrestricted advertising license to private participant information or replace separate photo/video permission.

Conversation participants can view and retain what you share. Authorized administrators may review messages for service administration, reports, safety, and compliance. MTC may remove inappropriate content or restrict access. General chat is not a secure channel for detailed medical histories, identity documents, payment details, passwords, or verification codes.

9. Website content and external services

MTC and its licensors retain rights in website text, logos, images, and other protected content. You may use the site for its intended purposes and keep copies of your own receipts and records. Other uses require permission or a valid legal basis. Do not use MTC branding to imply an endorsement or reproduce identifiable participant media without authorization.

External websites, embedded media, authentication, and payment services may have their own terms. MTC does not control every action of an external provider. An external link does not by itself establish endorsement.

10. Availability, responsibility, and disputes

We aim to provide accurate, useful services, but pages may contain errors and services may be interrupted. Do not rely on a website status that is clearly inconsistent with an event team's direct instructions; contact MTC for clarification. Nothing here permits MTC to retain a payment where a refund is legally required or to disregard a confirmed obligation.

To the extent permitted by law, MTC is not responsible for indirect or consequential losses arising solely from use or unavailability of the website. This limitation does not exclude or limit liability for fraud, willful misconduct, gross negligence, personal injury where liability cannot lawfully be limited, violation of law, or any other nonwaivable duty or remedy. It is not a release of liability for participation in a surf event.

California law governs these terms to the extent permitted, without displacing mandatory protections that apply to you. You may contact us about a concern so we can try to resolve it. Doing so is not a prerequisite to exercising a legal or payment-dispute right and does not extend an applicable deadline. These terms do not require mandatory arbitration, waive a jury or class action right, prevent a lawful payment dispute, or limit access to small-claims court or a regulator. If one provision cannot be enforced, the rest remains effective to the extent permitted by law.

11. Changes and contact

We may update these terms prospectively with a new effective date and appropriate notice. Material changes requiring renewed acceptance will be presented for acceptance. We will not retroactively remove rights attached to an earlier transaction by changing this page.
